1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FoxScrape ("we," "our," or "us") governing your access to and use of the FoxScrape web scraping API service available at foxscrape.com (the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
2. Definitions
For purposes of these Terms:
- "Service" refers to the FoxScrape web scraping API and all related services, features, and functionality
- "API" refers to the application programming interface provided by FoxScrape
- "Credits" refers to the usage units consumed when making API requests
- "Account" refers to your registered user account with FoxScrape
- "Content" refers to data, text, images, and other materials accessed through the Service
- "Target Website" refers to any website or web resource you scrape using our Service
3. Account Registration
3.1 Eligibility
To use the Service, you must be at least 18 years old and have the legal capacity to enter into contracts. By creating an account, you represent and warrant that you meet these requirements.
3.2 Account Creation
You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
3.3 Account Security
You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach. We are not liable for any losses resulting from unauthorized use of your account.
3.4 One Account Per User
You may only create and maintain one account unless explicitly authorized by us in writing. Creating multiple accounts to circumvent usage limits or restrictions is prohibited.
4. Acceptable Use Policy
4.1 Permitted Use
You may use the Service for lawful purposes, including data collection, research, monitoring, and analysis, provided you comply with these Terms and all applicable laws and regulations.
4.2 Prohibited Activities
You agree NOT to use the Service to:
- Violate any laws, regulations, or third-party rights
- Scrape websites that explicitly prohibit automated access in their terms of service or robots.txt
- Collect personally identifiable information (PII) without proper authorization and consent
- Engage in unauthorized competitive intelligence or corporate espionage
- Scrape data for spam, phishing, or fraudulent purposes
- Overload or attempt to disrupt target websites or our Service
- Circumvent technical protection measures or authentication systems
- Resell or redistribute scraped data that violates copyright or intellectual property rights
- Use the Service to build a competing product or service
- Engage in any form of network abuse or denial-of-service attacks
- Scrape government websites, healthcare data, financial information, or other sensitive data without proper authorization
- Bypass rate limits or usage restrictions through technical means
- Share your API credentials or access with unauthorized parties
4.3 Responsible Scraping
You agree to:
- Respect the robots.txt files and terms of service of target websites
- Implement appropriate rate limiting to avoid overloading target websites
- Use reasonable request intervals and patterns
- Identify your scraping activity with accurate user agent strings when required
- Obtain necessary permissions before scraping protected or authenticated content
- Comply with data protection regulations (GDPR, CCPA, etc.) when handling personal data
4.4 Target Website Compliance
You are solely responsible for ensuring your use of the Service complies with the terms of service, acceptable use policies, and legal requirements of target websites. We are not liable for any violations or disputes arising from your scraping activities.
5. Service Description
5.1 API Capabilities
Our Service provides the following capabilities:
- Basic Requests: HTTP requests to scrape static web pages (1 credit per request)
- JavaScript Rendering: Execute JavaScript and scrape dynamic content (5 credits per request)
- Screenshots: Capture webpage screenshots (5 credits per request)
- AI Extraction: AI-powered data extraction and parsing (5 credits per request)
5.2 Credit System
The Service operates on a credit-based system. Different API operations consume different amounts of credits as specified above. Credits do not expire but are non-transferable and non-refundable.
5.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.
6. Pricing and Billing
6.1 Subscription Plans
We offer the following subscription plans:
- Free Plan: 1,000 credits (no payment required)
- Freelance Plan: $20/month for 250,000 credits
- Startup Plan: $40/month for 1,000,000 credits
- Business Plan: $100/month for 3,000,000 credits
6.2 Payment Terms
Paid subscriptions are billed monthly in advance. You authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
6.3 Price Changes
We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice of any price increases for existing customers. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6.4 Taxes
All fees are exclusive of applicable taxes, which you are responsible for paying. We will collect taxes where legally required to do so.
6.5 Overages
If you exceed your credit allocation, the Service may be temporarily suspended until you upgrade your plan or your credits renew. We do not automatically charge for overages without your consent.
7. API Usage Terms
7.1 Rate Limits
We may impose rate limits on API requests to ensure fair usage and service stability. Current rate limits will be documented in our API documentation and may vary by subscription plan.
7.2 Data Retention
We may temporarily cache scraped data to improve performance and reduce costs. Cached data is typically retained for 1-7 days and then automatically deleted. We do not permanently store scraped content.
7.3 API Keys
You will receive API keys to authenticate your requests. You must keep your API keys secure and not share them publicly. You are responsible for all activities conducted using your API keys.
7.4 Service Availability
While we strive for high availability, we do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or emergency fixes that temporarily affect service availability.
8. Intellectual Property
8.1 Our Intellectual Property
The Service, including all software, technology, algorithms, designs, trademarks, and documentation, is owned by FoxScrape and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
8.2 Your Content
You retain all rights to data you scrape using the Service. However, you are responsible for ensuring you have the legal right to collect and use such data.
8.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may use such feedback without any obligation to you.
9. User Responsibilities
9.1 Legal Compliance
You are solely responsible for ensuring your use of the Service complies with all applicable laws, regulations, and third-party terms of service. This includes but is not limited to:
- Copyright and intellectual property laws
- Data protection regulations (GDPR, CCPA, etc.)
- Computer fraud and abuse laws (CFAA, Computer Misuse Act, etc.)
- Terms of service of target websites
- Anti-spam and telecommunications laws
9.2 Due Diligence
Before scraping any website, you should:
- Review the target website's terms of service and robots.txt
- Assess whether the data you intend to collect is publicly accessible
- Determine whether your intended use is lawful and ethical
- Obtain necessary permissions or licenses when required
9.3 Data Processing
If you collect personal data using our Service, you must:
- Have a lawful basis for processing personal data
- Provide appropriate privacy notices to data subjects
- Implement appropriate security measures
- Respect data subject rights (access, deletion, etc.)
- Comply with data retention and deletion requirements
10. Service Availability and Support
10.1 Uptime
We aim to maintain high service availability but do not guarantee any specific uptime percentage. The Service is provided "as available."
10.2 Maintenance
We may perform scheduled maintenance that temporarily affects service availability. We will provide advance notice of planned maintenance when possible.
10.3 Support

11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us at foxscrape@gmail.com. Upon termination, you will lose access to the Service and any unused credits. We do not provide refunds for early termination.
11.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms or our Acceptable Use Policy
- Your use of the Service poses a security or legal risk
- You fail to pay applicable fees
- You engage in fraudulent or abusive behavior
- We are required to do so by law
11.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
- Scraped data will be complete, accurate, or current
You assume all responsibility for selecting the Service to achieve your intended results and for the use and results obtained from the Service.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOXSCRAPE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business
- Loss of data or information
- Business interruption
- Legal fees or costs
- Damages arising from claims by third parties
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
These limitations apply regardless of the legal theory on which the claim is based, whether contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless FoxScrape and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of third parties, including target websites
- Your violation of any applicable laws or regulations
- Your scraping activities or use of scraped data
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate in asserting any available defenses.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FoxScrape is established, without regard to its conflict of law provisions.
For users in the European Union, nothing in these Terms affects your rights under mandatory local consumer protection laws.
15.2 Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good faith negotiations.
15.3 Arbitration
If negotiations do not resolve the dispute within 30 days, either party may initiate binding arbitration. The arbitration shall be conducted in English and governed by mutually agreed arbitration rules.
15.4 Exceptions
Either party may seek injunctive or equitable relief in court to prevent or address infringement of intellectual property rights or violations of confidentiality obligations.
15.5 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page with a new "Last Updated" date
- Sending an email notification to your registered email address
- Displaying a prominent notice on the Service
Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and FoxScrape regarding your use of the Service.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet infrastructure failures.
17.6 Export Compliance
You agree to comply with all applicable export and import control laws and regulations in your use of the Service.
17.7 U.S. Government Users
If you are a U.S. government entity, the Service is a "commercial item" as that term is defined in Federal Acquisition Regulation (FAR) 2.101, and you acquire only those rights set forth in these Terms.
